1. Sponsor
Retro Lovely Magazine 10 Year Anniversary (“Competition”) is sponsored by Retro Lovely Magazine (“Sponsor”).
2. Eligibility
Entrants must be female and 18 years of age or older, void where prohibited by law. Employees and agents of Retro Lovely Magazine and its affiliates and/or subsidiaries (collectively, the “Promotion Entities”), are ineligible to participate.
All entries for the Open Contest must be received by March 23rd 2020 to be eligible for inclusion in the Competition.
Entries for the Partner Studio contest will be submitted by those partner studios by April 30th.
3. How to enter
During the entry period, Open Contest participants may visit https://form.jotform.com/200003601650131 to complete your submission. With the Partner Studio contest, participating models need to take no further action as all submissions will be handled by those participating partner studios. An entry will not be accepted unless the Entrant acknowledges that she accepts and agrees to be bound by all Competition rules. Photos submitted should not include any promotional logo and/or trademarked/copyrighted images/text. Photos submitted must not infringe on third-party rights and must be suitable for publication. Photos should not contain obscene or otherwise offensive content. Photographs that include more than one individual or otherwise do not conform to the specifications described above will not be accepted, and the entries to which such photographs relate will not be eligible for inclusion in the contest. Submission of a qualifying entry grants Sponsor and its agents the right to publish, use, adapt, edit, and/or modify such entry in any way, in any and all media, without limitation and without consideration to Entrant. Submission of an entry further constitutes Entrant’s consent to irrevocably assign and transfer to Sponsor any and all rights, title, and interest in the entry, including, without limitation, all copyrights reserved.
4. Competition period
Open Contest
VOTING (BEGINS January 4th)
Round 1: TOP 10 (Starts January 4th and Ends April 15th) – Public voting will determine 10 finalists.
FINALS (VOTING RESETS)
Round 2: As some participants may enter the contest later than others, the 10 models with the most votes will move on to a final round of voting in a new online gallery so that each will have an opportunity to have equal time to attract votes. This segment will run from April 18th through May 5th with the winner announced on May 9th.
5. Public voting
During the Open Competition, anyone voting with a valid “Real” Facebook account (“Voter” or “Voters”) may cast one or more votes for one or more entrant. Voters will be permitted to vote once every 24 by logging in to vote for their favorite entrant. Retro Lovely Magazine has contracted with https://woobox.com/ to host the voting gallery and administer all aspects pertinent to the voting aspect of the contest. Qualifying votes shall only be cast in accordance with the instructions as listed in the competition terms and conditions. “Bot” activity or any kind of robotic or automated voting mechanism is not an acceptable form of voting. If this type of false voting is detected by our server, the associated IP address will be banned from voting. Retro Lovely Magazine reserves the right to disqualify entrants suspected in partaking in this type of activity, or any other voting activity we deem unfair.
Winner of the participating Partner Studio will be voted on by all Retro Lovely Partner Studios and promotion sponsors. Each partner studio and sponsor will get three votes – partner studios will only be allowed one vote for one of their own images. Two rounds will occur. First round will narrow down images. Second round of voting will be done the same and narrow down to the winner.
6. Conduct
By entering, Entrants agree that all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, Entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Competition, shall be governed by, and construed in accordance with, the laws of the State of Pennsylvania without giving effect to any choice of law or conflict of law rules, and Entrants consent to the jurisdiction and venue of the federal, state, and local courts located in Schuylkill County, Pennsylvania. Failure to comply with these Official Rules may result in disqualification. Sponsor reserves the right, in its sole discretion, to disqualify any individual: (a) acting in any manner deemed by Sponsor to be in violation of these Official Rules; or (b) acting in any manner deemed by Sponsor to be unsportsmanlike, disruptive, and/or with intent to annoy, abuse, threaten, or harass any other person. “Bot” activity or ANY automated or mechanical methods are NOT an acceptable form of voting. If this type of false voting is detected by our software, the associated IP address will be banned from voting. Retro Lovely Magazine Reserves the right to disqualify entrants suspected in partaking in this type of activity, or any other voting activity we deem unfair. ANY ATTEMPT BY A USER OR ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE COMPETITION IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND COSTS (INCLUDING WITHOUT LIMITATION, ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
8. Winner
Winner will be selected as outlined above Entrants consent to the use of their name, photos, and/or likenesses for advertising and trade purposes in connection with this promotion in any and all media known or hereinafter invented without territorial or time limitations and without additional compensation, except where prohibited. No Grand Prize substitutions or cash redemption allowed. By accepting prize, the winner acknowledges compliance with these Official Rules. To the extent that any federal and/or state income or other taxes apply to the value of the prize(s) and/or award(s) provided to the winning Entrant, the winning Entrant shall be solely responsible for the reporting and payment of such taxes.
9. Verification of winner
Potential winners will be required to execute an affidavit of eligibility, a liability/publicity release, and other documents (“Prize Claim Documents”), as may be required or permitted by law. If any potential winner fails or refuses to sign and return all Prize Claim Documents within fourteen (14) days of prize notifications sent, the winner may be disqualified and an alternate winner may be determined/selected. Sponsor is not responsible for any change in address of Entrants.
10. General
By entering this Competition, participants agree to abide by and be bound by these Official Competition Rules and the decisions of the judges, which are final in all matters related to the Competition. Promotion Entities also reserve the right, at their sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Competition. This Competition is subject to all applicable federal, state, and local laws. By participating in the Competition, participants agree to be bound by these Official Rules and the decisions of the judging organization and waive any right to claim ambiguity in the Competition or these Official Rules. Winner and participants also agree to release, discharge, indemnify, and hold harmless the Promotion Entities, and the officers, employees, contractors, and agents of each, from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse, use, loss, or misdirection of any prize, or participation in any Competition-related activity or participation in this Competition, or any other error in the offering or announcement of any prize and hereby waive all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; all causes of action arising out of or connected with this promotion, or any prize awarded shall be resolved individually, without resort to any form of class action; and any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs.
